What information is required to get a quote?

Santam works exclusively through licensed insurance brokers. A completed proposal form – available by clicking the Downloads button on this page – is required, If you don’t have one yet, start with:

 

  • Website address and estimated turnover (incl. export splits).
  • Record of past liability claims and incidents.
  • Trading contract terms.
  • Indemnity limits and cover required.
  • Any supporting risk information (e.g., risk protocols, standard operating procedures, and surveys).

Where do liability claims come from?

Claims can arise from:

 

  • Third parties the client has contracted with.
  • Third parties who suffer injury or damage caused by the insured.
  • In some cases, depending on the nature of the insured’s operations, claims can come from anyone, anywhere in the world.

Does the insured only need Products Liability cover if they manufacture a product?

No. Under South Africa’s Consumer Protection Act (CPA), any party in the supply chain can be held legally liable for harm caused by a product. This includes distributors, wholesalers, suppliers, retailers, importers, and installers.

 

Santam’s Product Liability cover protects any business involved in designing, formulating, specifying, manufacturing, constructing, installing, selling, supplying, distributing, treating, servicing, altering, or repairing tangible goods.

Can cover extend to operations outside South Africa?

Yes. The policy can be extended to include operations elsewhere in Africa. However, compliance with local regulations is essential to avoid fines or claim complications, as many African countries restrict non-admitted insurance.

Does liability cover protect the insured’s own financial losses?

No. Liability insurance covers claims made by third parties and does not compensate the insured for their own financial losses.

Does my policy cover contracts I enter into?

Santam’s Broadform Liability policy covers both delictual (tort) liability and certain contractual liabilities. However, some exclusions apply – for example, fines or penalties that you have contractually agreed to may not be covered.

Should incidents be reported even if the insured isn’t liable?

Yes. Any incident related to your business operations should be reported. Our claims team will assess the situation and advise on the appropriate next steps, even if you believe your business isn’t at fault.
